Tax Help for H2A Workers
Farmers may apply with the U.S. government to hire workers from other countries on temporary work visas called H2A visas. Not all work visas are H2A visas. If you are not sure what kind of visa you have, check your passport or other immigration documents.

What are the proposed changes to U.S. Immigration rules?
Last October, the U.S. Department of Homeland Security proposed updates to its “Public Charge Rule.” The new version of the rule could scare eligible immigrants away from valuable public benefits that could improve their health and increase their financial stability.
The Public Charge Rule allows immigration officials to deny a person’s application to enter the U.S. or stay in the country permanently if it is determined the applicant is likely to be a “Public Charge.” A Public Charge is loosely defined as a person who depends primarily on the government for survival. For example, someone who relies on cash assistance for income may be considered a Public Charge. No single factor determines whether someone is a Public Charge. Officials can consider age, health, financial status, and whether an applicant has received certain government benefits in the past when making the determination.
The proposed changes to the Public Charge Rule would give immigration officials a wider range of public benefits programs to consider when deciding if someone is likely to be a Public Charge. For example, benefits programs like SNAP (food stamps), Medicaid, and Section 8 Housing Choice Vouchers would now be considered when they were not considered before. This would likely increase the number of people who are denied immigration status under the Public Charge Rule.
The new rule has not yet been approved, but it has already caused fear and confusion among immigrant communities. Media outlets have reported that immigrants are terminating their benefits out of fear of being labeled a Public Charge if they apply to change their immigration status in the future. Without benefits, it will be harder for families to get the food and healthcare that they need. Legal Aid is concerned about these developments, and will pay close attention to the effect this rule would have on our clients who are immigrants and their families.

What does the “Immigration Ban” mean?
What is it?
The Executive Orders issued this year related to immigration and the court cases that followed them have created a new maze of regulations for people entering the United States. Most recently, Executive Order 13780 (EO-2) barred the entry of nationals of Iran, Libya, Somalia, Sudan, Syria, and Yemen from entering the United States for 90 days. It also barred all refugees form entering the U.S. for 120 days, and barred Syrian refugees indefinitely.1 EO-2 does not apply to the following groups of people:
- Lawful permanent residents,
- Dual nationals traveling on a passport issued by a non-designed country,
- Individuals admitted to United States on or after June 29, 2017 (effective date of EO-2),
- Diplomatic visas holders,
- Asylees/refugees already admitted into the U.S., and
- Those granted withholding of removal, and protection under the Convention Against Torture or advance parole.2
EO-2 did not reference individuals seeking to enter the U.S. to apply for asylum. Two federal district courts delayed implementation of EO-2 when they issued injunctions. Then, on June 26, 2017, the United States Supreme Court partially lifted the injunctions on the ban. The Court limited the ban so that nationals from the affected countries who have a credible claim of a “bona fide relationship” with a U.S. person or entity may still enter.3
What Constitutes a “Bona fide” Relationship?
The Court did not define “bona fide relationship” but required a “close familial” relationship with respect to persons. The Department of State interpreted “close familial,” to include:
- Mothers- and fathers-in-law,
- Adult sons, daughters and siblings and
Initially, grandparents, grand-children, aunts, uncles, nephews, cousins, brothers- and sisters-in-law and any other family member were not considered to be “close” family members.4 However, on July 20, 2017, the Court denied the government’s motion seeking clarification and failed to overrule a Hawaii District Court decision, suggesting such people are considered as having a “close familial relationship.”
The Court also provided that one’s relationship to a U.S. entity must be formal, documented, and formed in the “ordinary course” – not with the purpose of evading EO-2.5 In addition to close family connections, other “bona fide” relationships that exempt a person from the ban exist for workers who have been offered employment with a U.S. company, students accepted into a U.S. university, and, academic lecturers from the affected countries invited to speak at a U.S. institution as long they provide documents to prove the relationships.

Are there protections for people who have overstayed their visa while seeking a green card?
Even green card-seekers who already have an approved alien relative petition may still have an immigration problem if they have overstayed their visas or illegally entered the United States before or while waiting for a green card. This situation is also known as “unlawful presence,” and it makes the application process more difficult and more likely to be denied.
Immigrants in this situation may want to apply for a waiver to excuse the unlawful presence. In the past, immigrants first had to interview at the consulate or U.S. embassy in their home countries for the green card application. In the case of an unlawful presence, the immigration officer would deny the application. These immigrants would be allowed to apply for the waiver.
This process could take weeks or months and if the waiver was denied, could result in being banned from entering the U.S. for 3 or 10 years.
Since August 2016, some people may be eligible for a provisional waiver. The person applying for the waiver must be the spouse or child of a citizen or green card holder and at least 17 years old. They cannot be in removal proceedings. The only reason for denying their green card application is the unlawful presence. Finally, the applicant must prove that it would be an extreme hardship for the citizen or green card holder to live without the applicant or to relocate with the applicant.
Immigrants may apply for the waiver while in the U.S., even if they are unsure all the requirements are met. This way, they will know if their waiver applications are approved before needing to leave the country. If a waiver is approved, the process for getting a green card is much easier. However, it still requires returning to a person’s home country and interviewing with the consulate. Although the U.S. will initially deny the application, the waiver will allow the person to receive a green card.

What are my Rights during Contact with Police or Immigration Agent?
Everyone in the United States, regardless of immigration status, has certain rights when interacting with the police and immigration agents. The rights include the right to remain silent, the right NOT to answer questions about immigration status, the right to refuse to sign any papers without first consulting an attorney, and the right to seek help from a lawyer.

Update as of 2/9/2017: Federal Appeals Court, Executive Order on Immigration
A federal court of appeals decided on February 9, 2017 that President Trump’s executive orders restricting travel and immigration will remain suspended. Therefore, the rules described here are not currently in effect. This means that anyone from the seven affected countries who has been granted permission to enter the United States may do so.
The administration could now decide between a variety of next-steps: one of which includes a possible appeal to the United States Supreme Court. Since there is still uncertainty about the final outcome of these orders, if you are a citizen of or a lawful permanent resident (LPR) from any of the affected countries, contact an attorney to discuss your ability to re-enter before considering any travel outside of the United States.
Legal Aid may be able to assist low income U.S. citizens, lawful permanent residents, refugees, asylees, and non-citizen victims of crime, including domestic violence and human trafficking.

I am not fluent in English – do I have right to interpreter?
People who are not fluent in English have a right to an interpreter in many places, and options to enforce those rights.
Some common places that are required by law to provide interpreters are hospitals, public and charter schools, courts, public housing agencies, Social Security Administration, Internal Revenue Service, Veterans Administration, Unemployment Compensation, Bureau of Motor Vehicles, and the county Department of Job and Family Services.
A person not fluent in English should ask for an interpreter when going to these agencies. If they do not provide an interpreter, ask for a supervisor or for a customer service representative. If they still do not provide an interpreter, a person has the right to file a complaint with the U.S. Department of Justice. The police are also required to provide interpreters for people who are not fluent in English. In the City of Cleveland, if a law enforcement officer does not provide an interpreter while communicating with a constituent who is not fluent in English, that person can file a report with the Cleveland Police’s Office of Professional Standards and Civilian Police Review Board (OPS/CPRB). In addition to filing a complaint with OPS, a person also has the option to file a complaint with the DOJ for the denial of an interpreter by the police (see above DOJ contact info.). If the police force that denied service is one other than the City of Cleveland, the person can file their complaint with DOJ or check and see if there is a local option like in Cleveland.
What are the immigration consequences of old criminal convictions?
Legal permanent residents (LPRs) who are not citizens in the United States face serious immigration problems in addition to criminal penalties when charged with a crime. Any criminal conviction has serious consequences on a person’s immigration status. A person’s application for a visa may be denied or a person with legal status can lose it and be deported.
The immigration issues resulting from criminal convictions impact a person’s family and community. For example, a legal permanent resident (LPR) lived in the U.S. since 1974. In 1989, at the age of 18, he was convicted of possessing marijuana and placed on probation for two years. Due to his status as a LPR, he was notified in 2011 – nearly 27 years after his conviction – that he was being removed because he is an alien convicted of a violation of the law relating to a controlled substance.
Having entered the U.S. over forty years ago, the man has become a husband, a father, and a valued and contributing member to his church community. If he were deported, it would create significant hardship for himself, his family and his community.
In some instances, a person can avoid deportation through a process called “Cancellation of Removal.” To qualify for cancellation of removal, a person must establish at a hearing in immigration court that:
1. He has been a legal permanent resident for at least five 5 years;
2. Prior to committing the offense, he had at least 7 years of continuous residence in the U.S. after having been lawfully admitted in any status; and
3. He has not been convicted of an aggravated felony.

I know or am an immigrant suffering from domestic violence. Can I get help?
Anyone can be a victim of domestic violence, including immigrants. In fact, abusers often try to use a person’s immigration status as a method to control or abuse an immigrant victim. For example, a U.S. citizen husband who constantly threatens to call the immigration authorities on his undocumented immigrant wife and have her deported is abusing her.
The government recognizes that immigrants who are victims of domestic violence can be particularly vulnerable. There are special immigration laws that help protect immigrant victims of domestic violence. One allows immigrant spouses of US citizens (USC) or lawful permanent residents (LPR) who have a green card to file a petition for themselves to remove conditions of residency. A second allows victims who do not have a green card to file a self-petition if they meet certain criteria under the Violence Against Women Act (VAWA). A third option allows victims of violent crimes, including domestic violence, to apply for a U-Visa if they can demonstrate cooperation with law enforcement in the investigation or prosecution of the crime.
Option 1: Self-petition to remove conditions of residency
When a USC or LPR applies for permanent residency status for their immigrant spouse, the immigrant spouse is granted a green card with conditional residency for two years. Before the end of the 2 years, the immigrant spouse typically must file a joint petition, with their spouse, to remove the conditions. However, in abusive relationships, the USC or LPR spouse often refuses to file the joint petition. Abused immigrant spouses may file to remove the conditions on their residency by themselves if they can prove that they got married “in good faith” (not for immigration purposes), but during the marriage their spouse abused them. If the immigrant spouse is successful in their self-petition, they then receive permanent residency status and a 10 year green card.
Option 2: Violence Against Women Act Self-Petition
The VAWA self-petition is for immigrants who do not have a “green card, but who meet one of five categories:
1) they are married to an abusive USC or LPR spouse;
2) their USC/LPR spouse is abusing their child;
3) they were married to an abusive USC or LPR (as long as the divorce was within the last 2 years or the spouse lost their immigration status in the last 2 years);
4) they are the child of an abusive USC or LPR; or
5) they are a parent who is abused by their USC adult child.
Immigrants who complete a VAWA self-petition must show that they married their spouse in good faith, and if they were deported it would cause extreme hardship to themselves or their child. If the self-petition is approved, the immigrant victim gets a work permit and can apply for a green card.
Option 3: U-Visas for victims of crimes
A U-visa is a type of visa available to immigrants who are victims of certain crimes, including domestic violence. Other eligible crimes include rape, sexual assault, and sexual exploitation. The immigrant victim must show that they were helpful to law enforcement in the investigation or prosecution of the crime. If a U-visa application is approved, the applicant gets a work permit valid for four years. Also, after having U-visa status for 3 years, an immigrant can apply for a green card.

I am an H-2A worker. May I claim my spouse and/or children as dependents on my tax return?
Workers with dependents who live in Mexico, Canada or the United States may claim exemption deductions for their dependents. The worker’s spouse and dependents need a Social Security Number or an Individual Tax Identification Number (ITIN) to claim exemptions. If a dependent is not eligible for a Social Security Number, the dependents may apply to the IRS for an Individual Tax Identification Number (ITIN) when the tax return is filed.
I employ H-2A workers. Should I withhold taxes from their pay?
While withholding is not required by law, withholding may benefit both H-2A employers and H-2A workers. Withholding creates an incentive for H-2A workers to file a tax return. When workers file tax returns, the IRS does not have to initiate collection efforts, and employers do not have to deal with hassles such as wage garnishment. If an H-2A employer does not withhold income, the worker should make estimated payments to avoid owing a lot of taxes at the end of the year.
Are H-2A workers able to get Social Security Numbers?
Yes. All H-2A workers are eligible for Social Security Numbers and should have one in order to file their taxes. To obtain a Social Security Number (SSN), the worker must complete Form SS-5 and take it to a Social Security Office with a current passport and current H-2A visa. An H-2A worker should not use an Individual Taxpayer Identification Number (ITIN) to pay his or her taxes. Dependents of an H-2A worker who are not eligible for SSNs should obtain ITINs.
I employ H-2A workers. Should I give them a 1099 or a W-2?
H2A workers must receive a W-2 Wage and Tax Statement. They should not receive a1099. If an H-2A worker has filed taxes using a 1099, the employer should issue a corrected income statement on form W-2. If an H2A worker filed a return with a 1099, he or she should contact the Legal Aid Society of Cleveland to get help amending their prior returns. The worker should call Legal Aid at 1-888-817-3777.
Do H-2A workers have to pay taxes?
Yes. Foreign agricultural workers earning more than $600 are required to report this information in Box 1 of a W-2 Wage and Tax Statement. All H-2A workers should receive a W-2, and not a 1099 from their employer. For more information, please see IRS Publication 519 at http://www.irs.gov/publications/p519/index.html.
What is an H-2A worker?
Some U.S. employers apply for special temporary visas to hire foreign agricultural workers. These visas are called H-2A visas. You will know if you are an H-2A worker because your passport or immigration documents will state what kind of visa you have.
I am an immigrant. Am I eligible for in-state tuition?
In-state tuition is a lower tuition rate charged to students at public colleges and universities in Ohio who qualify as Ohio residents.
Some immigrants, including permanent residents (“green card” holders), qualify as Ohio residents and are eligible for in-state tuition for public colleges and universities in Ohio. Starting in the Fall of 2013, a person with a U Visa (victim of serious crime or family member of victim), T Visa (victim of human trafficking or family member of victim), or Deferred Action for Childhood Arrivals (DACA) may be eligible for in-state if she meets the other requirements set by the Ohio Board of Regents.
People with other types of immigration status may also qualify for in-state tuition. You may contact your school’s admissions office or the Ohio Board of Regents to find out if people with your immigration status qualify for in-state tuition in Ohio.
Do I have the right to an interpreter?
Do you or someone you know speak a language other than English (including American Sign Language)? Do you or they have trouble understanding and speaking English? If you answered yes to these questions, you have a right to an interpreter if you have to go to court. Persons with limited English skills should tell court staff right away that they need an interpreter. Once the court knows an interpreter is needed, then the court must provide one.
On January 1, 2013, the Ohio Supreme Court began following Rule 88. With this rule, the court must provide certified interpreters who know how to interpret in civil and criminal court for non-English speakers. Not all bilingual persons are qualified to interpret in court; special skills are needed.
Other agencies that get federal funding must provide interpreters according to the law. Some of them are:
- Legal aid, public defender, prosecutor and law enforcement;
- Public and charter schools;
- Public housing authorities;
- Federal agencies such as SSA, VA, and IRS;
- State agencies such as Department of Job and Family Services, Child Support Enforcement Agency, and Bureau of Motor Vehicles.
If you ask for an interpreter in court or at these agencies and you do not get one, you should ask to speak with a supervisor or ask where you can file a complaint. If an interpreter is still not provided, you may file a complaint with the U.S. Department of Justice (DOJ) by sending a letter or using the DOJ’s complaint form. In the letter or on the complaint form explain when and how they did not speak to you in your language or provide you an interpreter. Make a copy of the complaint or letter for your records. What are my rights if I am detained by Immigration & Customs Enforcement (ICE)?
As a detainee your rights include:
- Talking to an attorney about your case at your own expense
- Asking for release from custody on bond
- Contacting your country’s Consulate or Embassy
- Contacting your family members
- Medical care, food, visitation privileges, telephone access, marriage requests and religious services
I am a U.S. Citizen or Permanent Resident (“green card” holder). May I petition for family members?
As a U.S. Citizen you may petition for your spouse, parents, siblings, and children (married or unmarried) to get legal status in the U.S.
As a Permanent Resident (“green card” holder) you may petition for your spouse and unmarried children to get legal status in the U.S.
What is “deferred action,” and what children qualify?
On June 15, 2012 Secretary of Homeland Security Janet Napolitano issued a memorandum stating some individuals who came to the United States as children will qualify for “deferred action” for a period of two years. Deferred Action for Childhood Arrivals (DACA) is not a path to citizenship but does defer removal action (deportation proceedings) for an individual and allow the individual to apply for a “work permit”. With a valid work permit an individual may get a social security card and driver’s license or state ID. The initial two year period may be renewed for qualifying individuals.
To qualify for deferred action under this program, the individual must:
- have come to the U.S. under the age of 16;
- have continuously resided in the U.S. for at least five years preceding June 15, 2012 and are present in the U.S. on June 15, 2012;
- be in school currently, have graduated from high school, have obtained a GED certificate, or are honorably discharged veterans of the Coast Guard or Armed Forces of the U.S.;
- have not been convicted of a felony offense, a significant misdemeanor offense, multiple misdemeanor offenses, or otherwise pose a threat to national security or public safety; and
- not be above the age 30 on June 15, 2012.
Applications for DACA are now being accepted. Applicants may still apply if they have pending petitions or applications for other relief, such as a U Visa.

Immigration Rules: What Do Immigrants Need to Know about Unemployment Compensation?
Are immigrants eligible for unemployment compensation?
Yes, if you are an immigrant who has legal permission to work in the United States [have either an Employment Authorization Document (work permit) or are a Lawful Permanent Resident (LPR)], you may be eligible for unemployment compensation if you lost your job or your work hours were reduced due to COVID-19. Can undocumented immigrants receive unemployment compensation?
No, a person must have legal permission to work in the U.S. to be eligible for unemployment compensation.
How do I apply for unemployment compensation?
For detailed information about how to apply for unemployment compensation, please click here. Please note that the online unemployment compensation application is available in English only. If you speak a language other than English, call 877-644-6562 to complete your application over the phone. Because many people are applying for unemployment, you may have to wait on the phone for a long time. If I receive unemployment compensation, does that count against me for “public charge?”
No, immigration officials do NOT consider unemployment compensation when deciding whether a person is a public charge. Unemployment compensation is NOT a public benefit. For more information on public charge, click here.
Immigration Rules: How is the Public Charge Rule Affected by COVID-19?
What is public charge?
For over 100 years, whenever an immigrant has applied to enter the U.S. or stay in the country permanently, an immigration official has evaluated whether the immigrant is likely to become a “public charge.” Being a “public charge” is defined generally as someone who depends on the government for their basic needs.
A new rule about how the U.S. government determines whether someone is likely to become a public charge went into effect on February 24, 2020. Under the new rule, immigration officials can look at many aspects of the immigrant’s life, including his or her income, assets, credit score, education, work history, ability to speak English, and past receipt of public benefits. Based on that information, the immigration official then determines whether the immigrant is likely to receive certain public benefits for more than a total of 12 months in any 36-month period of time.
If the immigration official thinks that the immigrant is likely to receive public benefits for that amount of time, the official can deny the immigrant’s application to enter the U.S. or become a lawful permanent resident.
Does public charge apply to all immigrants?
No. It does not apply to the following groups of people:
- people who are applying for, or who have already received, U or T visas (usually victims of violence or human trafficking)
- people who are applying for, or who have already received, VAWA (Violence Against Women Act) status
- people who are applying for, or who have already received, SIJS (Special Immigrant Juvenile Status)
- people who are applying for, or who have already received, asylee or refugee status
- people who are already lawful permanent residents and are applying to beS. citizens
What if my U.S. citizen child receives public benefits?
If a US citizen child receives public benefits, but the immigrant parent does not, the child’s receipt of public benefits does NOT negatively affect the parent’s application to enter the U.S. or become a lawful permanent resident. In other words, an immigration official cannot use the child’s receipt of public benefits as a reason to decide that the parent is likely to be a public charge.
If you are concerned about whether your child should receive public benefits, please contact Legal Aid or talk to an immigration attorney before dis-enrolling your child from the program(s).
Do immigration officials consider all public benefits when deciding whether someone is a public charge?
No. Some benefits do NOT count when deciding if an immigrant is a public charge. Immigration officials are not allowed to consider the following:
- Special Supplemental Nutrition Program for Women, Infants, and Children (WIC)
- Emergency Medicaid
- Medicaid for pregnant women
- Medicaid used by children under 21 years of age
An immigration official cannot use an immigrant’s receipt of any of these benefits as a reason to decide that the immigrant is likely to be a public charge.
If I get tested or treated for COVID-19 and it was paid for by Medicaid or another public benefit, does that mean that I will be found to be a public charge?
No. If an immigrant is tested for, receives treatment for, or receives preventative care (such as a vaccine) related to COVID-19, even if the payment for the service is provided by a public benefit such as Medicaid, an immigration official may not use that as a reason to determine that the immigrant is a public charge.
If I receive medical care at a reduced rate, or for no cost, through a local hospital’s financial assistance program (like MetroHealth’s “rating” program), does that mean I will be found to be a public charge?
No, these kinds of programs are not public benefits and immigration officials cannot use your participation in such a program to determine that you are a public charge.

Immigration: What is happening at Immigration Agencies (EOIR, USCIS, an ICE) during COVID-19?
Will my hearing at Cleveland immigration court be cancelled because of COVID-19?
The Cleveland Immigration Court is not holding any hearings for people who are not in immigration detention. If your family member is detained, his or her hearing will happen as scheduled. If you or your family member is not detained and your hearing is supposed to take place between now and May 15, 2020, it will be rescheduled—you do not need to go to the court for your hearing.
You should frequently check the status of your case by calling 1-800-898-7180 or by visiting https://portal.eoir.justice.gov/InfoSystem/Form?Language=EN. You will need your A number, which is on all of the documents that you have received from the immigration court. It is a number that starts with the letter “A” and is followed by 8 or 9 digits.
The immigration court may not have rescheduled your hearing or updated the automated system yet. You should receive a notice in the mail from the court telling you that your hearing has been rescheduled. Make sure that the immigration court has your current address so they can send you the notice. To update your address with the immigration court, you need to complete and mail a Change of Address Form. The form is available at https://www.justice.gov/eoir/file/640091/download.

Will my appointment or interview with the immigration office (U.S. Citizenship and Immigration Services or USCIS) be cancelled because of COVID-19?
The USCIS office in Cleveland is closed until at least May 4, 2020. If your appointment or interview is scheduled between now and May 4, 2020, it will be rescheduled—you do not need to go to the USCIS office for your appointment.
You should receive a notice in the mail from USCIS letting you know that your appointment or interview has been cancelled. If you have moved since filing your application, you must update your address with USCIS. For information about how to update your address, visit https://www.uscis.gov/addresschange.

Will my check-in appointment with ICE be cancelled because of COVID-19?
Ohio ICE has not released general information about how they are currently handling check-in appointments. Our understanding is that an immigration officer should call you to reschedule your appointment. If you have not yet received a call from an officer, you should call the officer assigned to your case. This information may be on the documents you have received from ICE.
If you do not know the name and phone number of your ICE officer, call the Brooklyn Heights, Ohio office at 216-749-9955. If no one answers, leave a message with your name and A number. If you have trouble getting in touch with someone from ICE about your upcoming check-in appointment, please contact Legal Aid at 216-687-1900 (216-586-3190 for Spanish).
Will my family member who is detained for immigration reasons be released because of COVID-19?
Probably not. Immigration authorities (ICE) are not routinely releasing immigrant detainees from jail, same as before COVID 19. Family members may request a person be released from jail based on the danger that COVID-19 poses to his/her health. If your family member is detained at the Geauga County Jail and is at higher risk for severe illness as a result of coronavirus (See CDC list of people at higher risk ), please call our office at 216-861-5890 or 216-861-5310 to speak with a bilingual (English/Spanish) staff person.

Immigration: What should immigrants know about publicly available assistance during COVID-19?
If I am not a U.S. citizen, do I qualify for any of the government assistance programs created in response to COVID-19?
Just as before the coronavirus pandemic, certain immigrants – such as lawful permanent residents, asylees, and refugees – qualify for public benefits. The federal government and the state of Ohio have not changed list of the non-U.S.-citizens who can receive public benefits. So, if you qualified for public benefits before the COVID-19 pandemic, you still qualify for those benefits; if you did not qualify for public benefits before the COVID-19 pandemic because of your immigration status, you still do not qualify for those benefits.

Pregnant and breastfeeding women; women who recently had a baby; infants; and children up to five years of age may be eligible for WIC, regardless of their immigration status. WIC is a government assistance program that is available to make sure that women and their babies are healthy.

Yes, the policies against evictions and utility shut-offs apply equally to all people living in Ohio, regardless of immigration status.

What help can I get if I do not qualify for government assistance because of my immigration status,?
Food pantries throughout Ashtabula, Cuyahoga, Lake, Lorain, and Geauga counties are open to distribute food to individuals and families in need, regardless of a person’s immigration status. Some pantries ask that you bring a photo ID, proof of your family size and income, and proof that you are a resident of the city where the pantry is located. If you have a valid photo ID (driver’s license, green card, work permit, national ID from your home country, or passport), it is a good idea to bring it with you, but many of these pantries will likely be able to help you even if you do not have a photo ID or other documentation of your family size and income.
Food pantries are using social distancing measures by bringing food directly to your car and/or distributing food by appointment only. For this reason, you may want to call the pantry before you travel to the location to make sure you can receive help. Also, please be aware that the staff at these pantries may not be able to speak in any language other than English.

I need an interpreter for Court, what do I do?
In Ohio courts, you have the right to an interpreter in your native language if you have Limited English Proficiency, which means that you are not fluent in English. If you are Limited English Proficient and you have not been provided with an interpreter or have been denied an interpreter in any court in the State of Ohio, you may report the problem to the Ohio Supreme Court, Language Services Program. This program is responsible for making sure that Limited English Proficient individuals have access to courts.

Do you need to file papers in court but cannot afford the fees?
You might be able to reduce or avoid paying the filing fees up front with a “poverty affidavit” (or “affidavit of indigency”). Courts generally require a fee whenever a person files a new case or asks the court to do something by filing a “motion” in a pending case or files a “counterclaim” in a pending case.
But if you have a low income, you might be able to file your documents in court without the payment or with a lower payment if you first file a “poverty affidavit.” A poverty affidavit is a written, sworn statement that you have a low income and do not have enough money to pay fees.

Once you fill out the poverty affidavit, you must have your signature notarized and file the completed affidavit in the court where your case is being heard.
After you file a poverty affidavit in a case, the clerk will either not charge you any money or will charge you much less to file other documents in the same case. Even though you do not have to pay the fees up front, you may still be responsible for the fees at the end of the case.

If another organization or agency does not provide you with an interpreter, try asking to speak with a supervisor, customer service person or ombudsman (person who hears complaints).
If they say no, ask a supervisor, customer service person, or ombudsman (person who hears complaints) for an interpreter.
If they still do not provide an interpreter, you may file a complaint against them with the U.S. Department of Justice (DOJ). You may either send a letter or use DOJ’s complaint form, in English or your first language. You should explain when and how they did not speak to you in your language or provide you an interpreter. Spanish-Speaking Attorneys Help Domestic Violence Survivor Feel Safe After Distressing Experience
Isabel Ramirez Blancas left her home in Mexico for a new life in the United States, where she thought her U.S. citizen husband would petition for her residency status. But instead, he gave her a false ID card and forced her to work.
Compounding her disappointment, Ms. Ramirez suffered domestic violence at home. She never reported her situation because she was afraid to go to the police. Instead, Ms. Ramirez endured her husband’s abuse until the day she came home to find he had taken his own life.
With no husband, no income to support the couple’s young son, no documented status, and little English language ability, Ms. Ramirez was emotionally distraught. Her provider at MetroHealth’s McCafferty Clinic referred her to Legal Aid, where she met a Spanish-speaking staff attorney.
“I was very happy to come across a lawyer that spoke Spanish,” Ms. Ramirez said. “It made me feel I could trust her and the organization to do good work on my behalf.”
The Legal Aid attorney found that Ms. Ramirez was eligible to self-petition for legal permanent residency under the Violence Against Women Act, and helped her begin the process.
Immigration cases often span many years, and Ms. Ramirez’s was no exception. Initially, the petition was denied in 2013 because her abuser was no longer living, but Legal Aid helped her appeal the decision. After the appeal was granted on the self-petition, Legal Aid attorney Agustin Ponce de León filed for Ms. Ramirez’s adjustment of status and work authorization.
Three years after Ms. Ramirez first filed, the government approved all her petitions, giving her lawful permanent residency and work authorization. Mr. Ponce de León personally delivered her green card to her door.
As for Ms. Ramirez, she is working on her English via a course, and she and her son are setting down roots in the only hometown her son has ever known.
