CLE for Attorneys - Duty to Report: Dis-Barring the Misconceptions

At times in our practice, we may become aware of conduct that appears to violate professional standards or even put others in danger. What is our duty to report such conduct? How does attorney/client confidentiality impact that duty to report. And does Legal Aid have an established policy for such reporting? Join us for a virtual CLE seminar as we explore these issues.

  • Attorney Deborah Coleman will explain the circumstances under which the Ohio Rules of Professional Conduct require us to report attorney misconduct and the difference between reporting obligations for attorney misconduct and judicial misconduct.
  • Attorney Frank Hickman will explore the duty to report abuse or neglect of three specific groups: children, adults over 60 years of age, and individuals with developmental disabilities. We will discuss who has a duty to report and the standard for reporting for each group.
  • Legal Aid Deputy Director Tom Mlakar will explain Legal Aid’s policy and process for reporting the conduct and misconduct we’ve discussed.
